Terms & Conditions

These Terms and Conditions (“Agreement”) govern your access to and use of the mobile App, website, and related services (collectively, the “Platform”) operated by the mobile application- name (“Company,” “we,” “our,” or “us”). By downloading, installing, or using the Platform, you agree to be bound by this Agreement. If you do not agree, you must immediately cease all use of the Platform.

This Agreement constitutes a legally binding contract between you and the Company. Please read it carefully before proceeding.

  1. Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

  • “User,” “you,” or “your” means any individual or entity accessing or using the Platform.
  • “Listing” means any property advertisement, description, image, price, or related content posted on the Platform.
  • “Agent” or “Broker” means a licensed real estate professional who has registered on the Platform in a professional capacity.
  • “Content” means all text, images, data, videos, documents, and other materials available on or uploaded to the Platform.
  • “Transaction” means any purchase, sale, lease, rental, or other transfer of real estate interest facilitated through or in connection with the Platform.
  • “Personal Data” means information that identifies or can reasonably be used to identify you as an individual.
  1. Acceptance of Terms

By creating an account, accessing, or using the Platform in any manner, you:

  1. Represent that you are 18 years and above and possess the legal capacity to enter into binding agreements;
  2. Confirm that if you are acting on behalf of a company or organisation, you have the authority to bind that entity;
  3. Acknowledge that you have read, understood, and agree to comply with these Terms and Conditions, our Privacy Policy, and any other policies incorporated herein by reference;
  4. Consent to the collection, use, and sharing of your data as described in our Privacy Policy.

The Company reserves the right to modify these Terms at any time. Continued use of the Platform after any modification constitutes your acceptance of the revised Terms.

  1. Platform Description and Services

3.1 Nature of Services

The Square Foot Story (SFS) is a technology platform that facilitates connections between builders, brands, interior designers, architects, and end users. The Company does not act as a real estate agent, broker, or party to any transaction.

 

3.2 Services Provided

The Platform offers the following features and services:

  • Property search and listing discovery tools;
  • Geolocation-based property mapping and neighbourhood insights;
  • Direct communication tools between Users and Developers;
  • Property valuation estimates (indicative only, not professional appraisals);
  • Document upload and management facilities;
  • EMI, Circle Rate, Stamp Duty, and Interior cost calculators
  • Saved search and property alert notifications;
  • Reviews and ratings of builders’ projects.

3.3 Technology Platform Role

The Platform is a technology-based mobile application that enables users to discover, search, compare, and interact with real estate-related information, including, but not limited to, project listings, builder information, location insights, maps, media content, contact options, and other informational services available through the App.

The Platform provides digital tools intended to support property discovery and user decision-making. These tools may include search filters, location-based discovery, saved items, enquiry or contact features, informational content, and other app functionalities introduced from time to time.

It is only an intermediary technology service for information discovery and user convenience. It does not act as a real estate broker, real estate agent, property owner, developer, financial advisor, legal advisor, or guarantor of any property, listing, project, person, or transaction.

Any information, project details, builder content, pricing, location data, images, brochures, availability status, amenities, or other materials displayed on the platform are for general informational purposes only and may be sourced from third parties, partners, builders, agents, or other external sources. Users must independently verify all such information before making any legal, financial, or commercial decisions.

The availability, ranking, visibility, or display order of listings, projects, professionals, or other content on the Platform may be influenced by business rules, relevance, location, completeness of information, promotional arrangements, or other platform criteria.

If the Platform includes features such as call, message, WhatsApp, enquiry, or external redirection options, such features are provided solely as communication or convenience tools. The Platform does not guarantee response, availability, suitability, or outcome of any third-party interaction initiated through such features.

3.4 Services Provided

Depending on availability and app version, the Platform may offer one or more of the following services:

  • property and project search and discovery;
  • search filters and category-based browsing;
  • map and location-based insights;
  • projects, builders, architects, and interior designers
  • media content such as images, brochures, videos, or descriptive information;
  • enquiry, contact, call, message, or external communication options;
  • saved items, favourites, or shortlist functionality;
  • informational tools, calculators, alerts, or recommendations, where specifically made available through the App.

3.5 Availability

The Company strives to maintain continuous availability of the Platform, but does not guarantee uninterrupted service. Scheduled maintenance, updates, or unforeseen technical issues may result in temporary downtime. The Company will endeavour to provide advance notice of scheduled maintenance where practicable.

  1. User Accounts and Registration

4.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during login;
  • Maintain and promptly update your account information;
  • Keep your password confidential and do not share it with third parties.
  • Notify the company immediately at info@squarefootstory.com of any unauthorised use of your account.
  • Accept responsibility for all activities that occur under your account.

 

4.2 Account Type

The Platform offers the following account type:  Standard User accounts for individuals searching or listing properties, builders, interior designers, architects, and brands.

4.3 Account Suspension and Termination

The Company reserves the right to suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other Users, or is otherwise inappropriate. Upon termination, your right to use the Platform ceases immediately.

4.4 User Information and App Interaction Data

In connection with the use of the Platform, the App may collect and process certain information provided by Users or generated through their interaction with the Platform, including but not limited to name, phone number, email address, login details, enquiry details, preferences, saved items, search activity, click activity, page or screen views, device information, location data, and other usage-related analytics.

Such information may be collected and used for purposes including account creation, authentication, customer support, personalisation of user experience, improving search relevance, enabling communication features, analysing app performance, preventing fraud or misuse, and improving the services made available through the Platform.

By using the Platform, you acknowledge and agree that such information may be collected, stored, and processed in accordance with the Privacy Policy and applicable law.

  1. Listings and Property Information

5.1 Accuracy of Listings

The listings provided on the platform are solely taken from the government portals. The responsibility for the accuracy, completeness, and legality of the information provided is solely on the information given on the government portals.

5.2 Prohibited Listing Content

Listings that are not posted:

  • Contain false, misleading, or fraudulent information;
  • Violate any applicable fair housing, anti-discrimination, or consumer protection law;
  • Include properties to which you do not have the legal right to advertise;
  • Contain duplicate, spam, or ghost listings;
  • Include content that infringes third-party intellectual property rights;
  • Advertise properties that are subject to undisclosed legal encumbrances.

5.3 Removal of Listings

The Company reserves the right to remove any Listing at its sole discretion without notice. The Company shall have no liability for removal of any Listing, including any financial loss resulting from such removal.

  1. Intellectual Property Rights

 

6.1 Platform Ownership

All intellectual property on the Platform, including but not limited to software, code, design, trademarks, service marks, logos, graphics, and compilations of data, is the exclusive property of Square Foot Story or its licensors and is protected by applicable intellectual property laws.

6.2 User Licence

The Company grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal or professional real estate purposes. This licence does not include the right to:

  • Reproduce, distribute, or commercially exploit Platform content;
  • Reverse engineer, decompile, or disassemble any part of the Platform;
  • Frame or mirror any part of the Platform on any other website;
  • Use data mining, robots, or similar data-gathering tools.

6.3 User-Generated Content

By submitting Content to the Platform, you grant the Company a worldwide, royalty-free, perpetual, irrevocable, sub-licensable licence to use, reproduce, modify, adapt, publish, display, and distribute such Content in connection with the Platform. You represent and warrant that you own or have the necessary rights to grant this licence.

  1. Privacy and Data Protection

 

7.1 Privacy Policy

Your use of the Platform is subject to our Privacy Policy, available at www.squarefootstory.com, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, processing, and use of your Personal Data as described therein.

7.2 Data Security

The Company implements commercially reasonable technical and organisational security measures to protect your Personal Data against unauthorised access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is completely secure.

7.3 Location Data

The Platform may collect and use your precise geolocation data to provide location-based property search features. You may disable location services at any time through your device settings, but this may limit the functionality of the Platform.

  1. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable local, national, or international law or regulation;
  • Posting or transmitting any content that is defamatory, fraudulent, obscene, or discriminatory;
  • Impersonating any person or entity, including Company employees or Agents;
  • Engaging in any conduct that restricts or inhibits any other User from using the Platform;
  • Uploading malicious code, viruses, or any software designed to disrupt the Platform;
  • Using the Platform to solicit personal information from minors;
  • Circumventing the Platform to conduct Transactions without the Company’s knowledge for the purpose of avoiding fees;
  • Engaging in money laundering, fraud, or any other financial crime in connection with Transactions;
  • Scraping or harvesting data from the Platform without prior written consent from the Company.

 

  1. Fees, Payments, and Subscriptions

 

9.1 Free and Subscription

Certain features of the Platform are available free of charge, while others require payment of a subscription fee. Current pricing is available on the Platform and is subject to change with reasonable notice.

9.2 Payment Terms

All payments are subscription-based and are non-refundable except as expressly stated in this Agreement or required by applicable law. Payments are processed through third-party payment processors, and you agree to their applicable terms of service.

9.3 Subscription Renewal

Subscriptions will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

9.4 Taxes

You are responsible for all taxes, duties, and government charges applicable to your use of the Platform and any Transactions conducted through it.

  1. Disclaimers and Limitation of Liability

 

10.1 No Real Estate Advice

The Platform provides information for general purposes only. Nothing on the Platform constitutes professional real estate, legal, financial, investment, or tax advice. Square Foot Story (SFS) is not a registered real estate broker or agent. All property decisions should be made in consultation with qualified licensed professionals.

10.2 Platform Provided ‘As Is’

The Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability.

10.3 Limitation of Liability

To the fullest extent permitted by applicable law, Square Foot Story (SFS)  and its directors, officers, employees, affiliates, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or real estate opportunity, arising from your use of or inability to use the Platform, even if advised of the possibility of such damages.

In no event shall the Company’s total liability to you for all claims exceed the greater of: (a) the amount you paid to the Company in the twelve months preceding the claim; or (b) INR 8,000 (Indian Rupees Eight Thousand only).

10.4 Third-Party Services

The Platform may link to or integrate with third-party websites, services, or applications. The Company has no control over and assumes no responsibility for the content, privacy practices, or terms of any third-party services.

10.5 Data & Content Disclaimer

The information available on Square Foot Story is aggregated from a combination of publicly available sources, including government portals, official websites, and third-party data providers, along with user-submitted content.

Square Foot Story acts solely as an information and discovery platform and does not independently verify all data presented. We do not claim ownership of publicly sourced data and do not guarantee its accuracy, completeness, or timeliness.

Square Foot Story is not a government entity and is not affiliated with any government body unless explicitly mentioned. All users, including buyers, sellers, brands, builders, architects, and service providers, are responsible for verifying the authenticity and accuracy of information before relying on it. By using the Platform, you acknowledge that any reliance on such information is at your own risk.

10.6 Data Accuracy Disclaimer*

Square Foot Story aggregates information from publicly available sources, including government portals, business listings, and user submissions. While we strive to keep information accurate and up to date, we do not verify or guarantee the completeness, authenticity, or reliability of any listing, project, brand, or service.

Square Foot Story is not affiliated with any government authority unless explicitly stated. Users are strongly advised to independently verify all information, including approvals, ownership, pricing, specifications, and credentials, before making any decisions or engaging with any third party. Square Foot Story shall not be held liable for any discrepancies, losses, or decisions made based on the information provided on the Platform.

  1. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of or access to the Platform;
  • Your violation of any provision of these Terms;
  • Your violation of any third-party rights, including intellectual property or privacy rights;
  • Any Content you submit, post, or transmit through the Platform;
  • Any Transaction you enter into through or in connection with the Platform.
  1. Dispute Resolution

 

12.1 Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered, without regard to its conflict of law principles.

12.2 Informal Resolution

Before initiating any formal dispute proceedings, the parties agree to attempt in good faith to resolve any dispute informally by contacting the Company at info@squarefootstory.com. The Company will attempt to respond within thirty (30) business days.

 

12.3 Arbitration

If informal resolution fails, any dispute, controversy, or claim arising from or relating to these Terms shall be finally resolved by binding arbitration in accordance with the rules of a mutually agreed arbitration institution. The arbitration shall be conducted in English. The arbitrator’s decision shall be final and binding.

12.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis only and not as part of any class, consolidated, or representative action.

  1. Modifications to the Platform and Terms

The Company reserves the right, at its sole discretion, to:

  • Modify, suspend, or discontinue any part of the Platform at any time;
  • Amend these Terms with notice provided through the Platform or by email;
  • Update pricing for paid services with at least fourteen (14) days’ notice.

Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of such changes.

  1. Termination

Either party may terminate this Agreement at any time. You may terminate by deleting your account. The Company may terminate this Agreement immediately and without liability if you breach any provision hereof.

Upon termination, sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution shall survive.

  1. General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and the Company relating to the subject matter hereof and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

 

15.3 Waiver

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without the Company’s prior written consent. The Company may assign its rights and obligations without restriction.

15.5 Force Majeure

The Company shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, governmental actions, pandemics, strikes, or internet infrastructure failures.

15.6 Language

These Terms are executed in the English language. Any translation is provided for convenience only. In the event of conflict, the English version shall prevail.
